Terms of Service

These Terms of Service ("Terms") govern access to and use of the Triqai website, dashboard, and API (the "Services").

Triqai is a trade name of Rediant, registered in the Netherlands (KVK: 97621803). By accessing or using the Services, you agree to these Terms.

1. Scope of the Services

These Terms apply to the marketing website, dashboard, API, and related service components.

The Services are not intended for children.

2. Accounts and Organizations

  • An account is required for dashboard access and API key management.
  • Users may create or join organizations subject to product limits and policies in effect at the time of use.
  • Organization admins manage members, roles, billing settings, and API keys.

You are responsible for account credential security and activity under your account.

3. API Usage and Restrictions

You may use the API in production and internal applications, subject to plan limits and applicable law.

You may not misuse the Services, including attempts to bypass limits, abuse free tiers, reverse engineer protected components, or use the Services for unlawful activity.

4. Plans, Credits, Billing, and Changes

  • Plans include recurring credit allocations per billing cycle.
  • Unused credits do not roll over unless explicitly stated in plan terms.
  • Optional on-demand overage usage may be billed via payment provider integrations.

Triqai may update pricing, plans, and packaging with reasonable notice where required.

5. Free and Trial Plans

Free/trial plans may include hard limits, reduced support scope, and no uptime commitments.

6. Availability, Support, and SLA Position

For self-serve plans, Services are provided on an "as available" and best-effort basis without a default SLA.

Enterprise SLAs, support commitments, and remedies may be provided only where explicitly set out in an executed enterprise agreement, order form, or enterprise addendum.

7. Data Ownership and IP

  • Customers retain ownership of their customer data.
  • Triqai retains ownership of the Services, software, models, infrastructure, and related intellectual property.
  • Triqai may retain non-personal, aggregate, or de-identified service telemetry to operate and improve the Services, subject to applicable law.

8. Privacy and Data Protection

Personal data processing is governed by the Privacy Policy and DPA.

Transaction and transaction-linked data are retained for up to 90 days by default in Triqai systems, with additional retention rules for billing, security, and legal obligations as described in the Privacy Policy and DPA.

9. Suspension and Termination

Triqai may suspend or terminate access for abuse, non-payment, legal risk, or security risk.

Customers may terminate use and request deletion according to the Privacy Policy and DPA. Deletion is initiated promptly and completed according to system cleanup cycles and legal retention requirements.

10. Disclaimers

Except as expressly stated, Services are provided "as is" and "as available." Enrichment results are informational and should not be the sole basis for critical decisions.

11. Limitation of Liability

For self-serve plans and to the maximum extent permitted by law, Triqai's aggregate liability is limited to fees paid by the Customer in the preceding 12 months, and indirect/consequential damages are excluded.

If Customer and Triqai execute negotiated enterprise terms, liability terms in that agreement govern for that relationship.

12. Enterprise Contracting Precedence

If the parties execute an order form, enterprise addendum, or master service agreement, that executed agreement prevails over these public Terms to the extent of conflict and for the covered services/customer account.

13. Changes to Terms

Triqai may update these Terms from time to time. Continued use after an effective-date update constitutes acceptance, unless superseded by executed enterprise terms.

14. Governing Law and Jurisdiction

Unless otherwise stated in an executed enterprise agreement, these Terms are governed by Dutch law and disputes are subject to Dutch courts.
